10 Rules to Getting Divorced

Okay.  No matter how you got here, one thing is sure.  You want out.  You want to put an end to your spousal relationship – with all the suffering that will be entailed in doing so.

The important thing now then, is  to take the proportionate steps, and to act with thought and planning rather than just via gut reaction.  Whether you have decided to end your mariage due to  your spouses affair, abandonment, spousal abuse (verbal and/or physical) or because of lack of love , it is important to get legal advice throughout the process.

Below are the ten commandments which we advise that all of our clients who are considering getting a divorce follow:

 
 

First – the 5 Don’t rules.

1) Don’t act on the advice of friends and family. Your relatives, friends, and acquaintances – even if they were involved in a divorce – will not necessarily give you advice which is correct for your unique situation.  Taking advice from them can cause damage to your position vis-à-vis your spouse and all of the related divorce issues.

2) Don’t take any step against your spouse before you speak to an lawyer.. Divorce can result in significant legal proceedings which will be very influential on how your future life will look  - so it is important to get legal advice to help you direct your steps sagely and to protect your rights and to elucidate the legal situation. 3)  Don’t hesitate to contact the police if your fear domestic violence against you or against children.  Remember – shame can kill.

4)  Don’t allow joint account balances to increase unintentionally.  In Israel, debt in joint accounts is shared by both parties.  Don’t let your spouse get the joint accounts into huge overdrafts in order to put pressure on you. Go to the bank and ensure that transactions call for both spouses signatures.  Talk to an Israel Divorce Lawyer.

5)  Don’t incite the children against your mate. Remember that the crisis is only between you and your spouse. Children are the main victims of the divorce process. Keep them away from the divorce.  The further they are away from the conflict the less damage will occur to them. 

Next – the Five Positive rules.

6)  observe Secrecy. Avoid telling anybody your plans before you get legal advice and submit various legal claims in court. Maintaining confidentiality is crucial.  Remember that your home phone may be listened to by your spouse.

7)  Collect evidence of spouse behavior.  They may be relevant for proof for: proving an affair; or of mental or physical abuse; or of possession of certain assets; and for child custody.

8) Collect evidence of spouse’s earning capacity assets listed in their name. This will affect child support and division of property issues.  Act swiftly and soon –things may be hidden or otherwise disappear.  If necessary can get help from a private detective.

9) Make a will to determine who inherits your property. Just in case.  Remember, unless you have a will, then while you’re married, half of your assets go to your spouse upon your death.

10) Make every effort to reach a fair agreement.  Good agreements can regulate all disputed matters promptly and efficiently. Remember, the more information you have when negotiating the better your chances for a good deal and to protect your rights.
